When an ATO debt reaches the recovery stage, the letters change. Warnings about garnishee notices, director penalties and credit reporting start to arrive, and each has a deadline. The good news is that most recovery action can still be paused if you engage early and offer something realistic.
This guide covers how to stop or pause ATO recovery action in 2026-27, and clears up a common mix-up: Victorian land tax is not an ATO tax. It is assessed and collected by the State Revenue Office (SRO) Victoria under different rules. Figures were checked against ATO firmer action pages and the SRO land tax FAQs on 9 October 2026.
It is for business owners, directors and Victorian property investors juggling a federal tax debt and a state land tax bill. If you have letters you have not opened yet, start with our guide to what happens if you ignore ATO letters.
Key takeaways
- ATO recovery action can include garnishee notices, director penalty notices, credit reporting and court action.
- Engaging early is the main lever. A payment plan you keep to generally stops credit reporting, and debts of $200,000 or less can usually be set up online.
- GIC keeps running on a plan: 11.51% a year for October to December 2026, compounding daily.
- Victorian land tax is an SRO Victoria tax, not an ATO tax. The ATO cannot set up a plan for it.
- VIC land tax is based on land owned at midnight on 31 December. General threshold $50,000, trusts $25,000.
- Land tax objections: 60 days from receiving the assessment.

What counts as ATO recovery action?
Recovery action is what the ATO does after reminders and phone calls have not worked. The ATO lists these firmer actions:
- Garnishee notices. A garnishee notice requires your bank, employer or customers to pay money they hold or owe you to the ATO. For wages, usually up to 30 cents in the dollar of post-tax income.
- Director penalty notices. Directors become personally liable for the company’s unpaid PAYG withholding, GST and super guarantee charge (ATO director penalties).
- Credit reporting. Business debts of $100,000+ overdue more than 90 days can be reported to credit bureaus if you are not engaging.
- Departure prohibition orders, freezing orders and securities in more serious cases.
Beyond that, the ATO can take legal action: a bankruptcy notice for individuals or a statutory demand and winding-up application for companies. The scale is significant. In a September 2025 speech, the ATO said collectable debt was over $50 billion at 30 June 2025, with around two-thirds owed by small businesses, and that it issued 84,529 director penalty notices in 2024-25 (ATO speech). For one public example of how a tax debt can escalate, see our explainer on the Sam Wood ATO tax debt.
How do I stop or pause ATO recovery action?
- Read the notice and note the deadline. A director penalty notice or bankruptcy notice gives 21 days. A credit reporting notice gives 28 days.
- Lodge anything outstanding. The ATO cannot assess a realistic plan without your returns and activity statements, and late lodgment adds penalties. See our guide to the overdue tax return penalty.
- Work out what you can pay. Use current bookkeeping and a cash flow forecast. The ATO says to consider how much you can pay upfront and when you can pay in full.
- Call the ATO or have your tax agent call. Use the numbers on the ATO contact page. Debts of $200,000 or less can usually be put on a payment plan online.
- Keep to the plan and keep lodging. If a plan defaults, the full overdue balance becomes immediately payable, and new debts must be paid on time or put on a separate plan.
If you think the debt is wrong, you can object or dispute it, and an active objection stops credit reporting. Our ATO disputes service can help with that, and our article on ATO action in progress explains what that status on your account means.
Does a payment plan stop interest?
No. GIC keeps accruing on a plan and compounds daily. The GIC rate for October to December 2026 is 11.51% a year (0.03153425% a day), and GIC incurred from 1 July 2025 is not tax deductible. Our guide to ATO interest on overdue tax explains how to ask for remission.
Is Victorian land tax collected by the ATO?
No, and this is where many people get confused. Victorian land tax is a state tax administered by the State Revenue Office Victoria. The ATO has no role in assessing or collecting it, so an ATO payment plan does nothing for a land tax bill, and a land tax objection does nothing for an ATO debt. Land tax is also separate from council rates, as our guide to land tax vs council rates explains.
| Feature | ATO (federal) | SRO Victoria (state) |
|---|---|---|
| Taxes | Income tax, GST, PAYG, FBT, super guarantee charge | Land tax, duties, payroll tax |
| Key date | Due dates vary by obligation | Land owned at midnight on 31 December |
| Recovery tools | Garnishee notices, DPNs, credit reporting, court action | SRO collection processes for overdue land tax |
| Help if you cannot pay | Payment plans, GIC remission requests | Instalments via AutoPay, hardship relief |
| Objection time limit | Generally 2 or 4 years for assessments | 60 days (site value: 2 months) |
When is Victorian land tax payable?
According to the SRO FAQs, land tax is based on the land you own at midnight on 31 December of the year before the land tax year. Assessments are generally issued between January and June. Individuals pay when total taxable land value is $50,000 or more, and trusts from $25,000. Your principal place of residence can be exempt if you meet the SRO conditions.
You can pay the assessment by card or BPAY, or by AutoPay instalments (fortnightly, monthly or 4 payments) over up to 38 weeks from the issue date. AutoPay must be set up each year. If you have missed a due date, see the SRO’s overdue payments page, and if you are in serious hardship, the SRO offers hardship relief. Contact the SRO directly about either; we have not stated the SRO’s late payment interest or penalty figures here, so check them with the SRO.
Worked example: an ATO debt and a land tax bill at the same time
Sarah is a director. Her company owes $25,000 in overdue GST, which it reported on time. She personally owns a Melbourne investment property she held at midnight on 31 December 2025.
ATO side. Her agent lodges the outstanding activity statement, pays $5,000 upfront and sets up a payment plan for the remaining $20,000 at $2,000 a month. $20,000 / $2,000 = 10 months, but GIC keeps running. In the first 31 days, GIC on $20,000 is about $20,000 x (1.000315342531 – 1) = $196.44, so the plan runs slightly longer than 10 months unless she pays a little more.
SRO side. Her land is above the $50,000 threshold, so she receives a 2026 land tax assessment. The ATO plan does not cover it. She checks the assessment within 60 days and sets up AutoPay instalments with the SRO.
Rule of thumb: Federal tax debt goes to the ATO, Victorian land tax goes to the SRO. Deal with each on its own deadline, and never use money set aside for GST or PAYG withholding to pay land tax.
Common mistakes with ATO recovery action and land tax
- Asking the ATO about land tax. The ATO cannot help with an SRO assessment. Contact the SRO.
- Missing the 21-day window on a DPN. Once it passes, the remission options narrow.
- Proposing a plan you cannot keep. A default makes the full overdue balance payable at once.
- Relying on an out-of-date land tax threshold. Older articles quote $300,000. The SRO now lists $50,000 for individuals and $25,000 for trusts.
- Not checking the land tax assessment. Check your main residence is exempt and the land list is right, and object within 60 days if not. Our property tax planning service can review it.
FAQ about stopping ATO recovery action and VIC land tax
Does the ATO collect Victorian land tax?
No. Victorian land tax is a state tax assessed and collected by the State Revenue Office Victoria. The ATO collects federal taxes such as income tax, GST and PAYG withholding. An ATO payment plan or objection has no effect on a land tax assessment, and an SRO arrangement has no effect on your ATO debt. Each has to be dealt with separately.
How do I stop a garnishee notice from the ATO?
Contact the ATO as soon as you receive the warning letter or the notice. If you can pay in full, the notice falls away. If you cannot, the ATO may vary or withdraw the notice where you arrange suitable alternative payments, such as a payment plan you can keep to. Lodge any outstanding returns first so the ATO can see the full picture.
Does a payment plan stop GIC?
No. Debts on an ATO payment plan keep accruing the general interest charge, which compounds daily. The rate for October to December 2026 is 11.51% a year. Paying more upfront or clearing the plan early reduces the total interest. If your plan defaults, the full overdue balance becomes immediately payable.
When is Victorian land tax assessed?
Land tax is based on the land you own at midnight on 31 December of the year before the land tax year. Land you held at midnight on 31 December 2025 is assessed for the 2026 land tax year. The SRO says assessments are generally issued between January and June, with some reassessments issued at other times.
How long do I have to object to a Victorian land tax assessment?
The SRO says general objections must be received within 60 days of receiving the assessment, and late objections need reasons or they will be refused. Disagreements about site value must be lodged within 2 months, with no discretion to accept them late. You still have to pay by the due date while an objection is being decided.
