FOUNDER'S TAKE

Why registering a business name is more important than most founders realise

Many business owners assume that registering a business name automatically protects their brand. It doesn't. A business name simply allows you to trade under a name that isn't your personal or company name. The real challenge is making sure the name is available, appropriate for your structure and unlikely to create problems later.

Before registering a name, we help clients understand the difference between a business name, a company and a trademark. That simple conversation often prevents expensive rebranding exercises down the track. We also ensure your business name is correctly linked to your ABN and registered for the right term.

The registration process itself only takes minutes. Choosing the right name and structure is what protects your business long after the paperwork is complete.

Frequently Asked Questions

ASIC typically processes business name registrations within 24-48 hours if all information is correct and the name is available. Once approved, you can start trading under your registered business name immediately.

You can register your business name for 1 year ($47 ASIC fee) or 3 years ($108 ASIC fee). Three years costs $33 less than renewing every year ($141) and means fewer renewals. We suggest 3 years for established businesses and 1 year if you’re testing a new idea.

No. Once your business name is registered with ASIC, it’s protected nationwide. No one else can register an identical or deceptively similar name. However, registration doesn’t prevent similar trademark use, which is why we include trademark searches.
If you’re trading under your own legal name (e.g., “John Smith Plumbing” for John Smith), you don’t need to register. But if you’re using any other name (e.g., “Premium Plumbing Services”), you must register it with ASIC. It’s a legal requirement under the Business Names Registration Act 2011.
If your first choice is already registered, we help you choose alternative names that are available. We conduct searches for multiple options and advise on names that are strong, brandable, and compliant with ASIC rules. We only proceed once you approve an available name.

No. ASIC registers a business name against an ABN, so you need one first. If you don’t have one yet, leave the ABN box blank on the order form and we’ll help you apply for it (ABN registration is $99 + GST).

No. Business name registration and trademark registration are separate. ASIC business name registration gives you the right to use that name for trading in Australia. A trademark (registered with IP Australia) provides stronger legal protection against imitation. We can advise on whether you should also apply for trademark protection.

Your business name must not be identical to an existing registered name, must not include restricted words (like “bank” or “royal” without permission), shouldn’t be offensive, and must not mislead about your business activities. We ensure your chosen name complies with all ASIC rules.
