Setting up a self-managed super fund is mostly paperwork, but the order matters. Get one step out of sequence and the fund can sit in limbo, unable to accept a rollover or an employer contribution.
This guide walks through each setup step in the order the ATO sets out: choosing trustees, director IDs, the trust deed, the ABN and TFN application, electing to be regulated within 60 days, the bank account, the electronic service address, the investment strategy and the first rollover. Figures were checked against ATO, ASIC and business.gov.au pages for the 2025-26 and 2026-27 years.
It is written for people who have already decided an SMSF suits them and want to set one up correctly. If you are still weighing it up, read whether an SMSF is right for you and our look at the benefits and drawbacks of an SMSF first.
Key takeaways
- An SMSF can have up to 6 members, and every member must be a trustee or a director of the corporate trustee.

Should you use individual trustees or a corporate trustee?
This is the first decision because it shapes every document that follows. With individual trustees, each member is a trustee in their own name and assets are held in all their names as trustees for the fund. With a corporate trustee, a company is the trustee and each member is a director.
| Issue | Individual trustees | Corporate trustee |
|---|---|---|
| Asset titles | Change every title when a trustee joins or leaves | Titles stay in the company’s name |
| Single-member fund | Needs a second trustee | Member can be the sole director |
| Death or departure | Minimum of 2 trustees must be kept | Company continues as trustee |
| Reporting changes | New trustee reported within 28 days | Director changes reported to ATO and ASIC within 28 days |
| Extra costs | No ASIC fees | ASIC registration and annual review fees |
The ATO trustee structure page notes the ASIC annual review fee is lower when the company acts only as trustee of an SMSF. From 1 July 2026, business.gov.au lists company registration at $636. If you go corporate, set up the company first and read our director ID guide.
Who can be a trustee, and what must they sign?
Under the ATO rules, a trustee or director must be at least 18, not under a legal disability and not a disqualified person. A person with a conviction for a dishonest offence, a civil penalty order or current bankruptcy is disqualified, and acting as a trustee while disqualified is an offence.
- Written consent: every trustee or director consents in writing to the appointment. Keep it for the life of the fund and 10 years after it winds up.
- Trustee declaration: each person signs the ATO trustee declaration within 21 days of appointment. Keep it while they remain a trustee or for 10 years, whichever is longer.
- Director ID: ASIC says you must apply before you are appointed a director. The maximum penalty for not having one is 60 penalty units.
What does the trust deed need to say?
The deed is the fund’s rulebook. The ATO says it must be tailored to the fund, signed and dated by all trustees, executed under the relevant state or territory law, and state that the fund’s sole purpose is to provide retirement benefits to members or death benefits to their beneficiaries. A generic kit is acceptable only if the result still complies with current law and fits your fund.
Once the deed is executed and the first asset is held for the fund, the fund is legally established. That date starts the 60-day registration clock.
How do you register the fund and elect to be regulated?
Registration happens through one application on the Australian Business Register: you apply for an ABN and TFN for the fund and, in the same application, elect for the fund to be regulated by the ATO. The ATO registration page says you have 60 days after establishment to do this. Without the election, the fund does not get concessional tax treatment and employers cannot claim deductions for contributions to it.
The application asks for each associate’s name, date of birth, position and either TFN or residential address. Details that do not match ATO records can delay or stop the ABN. Most SMSFs do not need to register for GST unless GST turnover is more than $75,000.
What the Super Fund Lookup statuses mean
- Pending: shown after you apply.
- Registered: can take up to 56 days. Other funds and employers will not transfer money before this.
- Notice of compliance: issued within 7 days of Registered status.
- Regulation details withheld: the ATO is reviewing the application.
What do you need before the first rollover?
While the application is processed, finish three things. First, open a bank account used only by the fund, with a name that shows the trustee and the fund. Second, get an electronic service address; a fund can record only one ESA, so pick a provider that handles both contributions and rollovers. Third, tell the ATO the bank and ESA details.
Once Registered, ask your existing fund to roll your balance over. Contributions and rollovers must be allocated to member accounts within 28 days after the end of the month they arrive.
What goes into the first investment strategy?
The ATO’s investment strategy guidance requires a written strategy tailored to the fund, not a copy of the legislation. Ranges of 0 to 100% for every asset class are not enough on their own. It must be reviewed at least annually. Our SMSF investment strategy guide covers the content, and if property is on the list, read how a bare trust works for SMSF property and the ATO rules on limited recourse borrowing arrangements.
Worked example: a two-member fund with a corporate trustee
Priya and Arjun both get director IDs, then register a company. They are appointed directors on 1 August 2026 and sign the trust deed the same day, with $10 settled to establish the fund.
Trustee declarations: due within 21 days of 1 August, so by 22 August 2026 (1 + 21 = 22).
Registration: 60 days from 1 August. August has 31 days, so 30 days takes them to 31 August and the remaining 30 days to 30 September 2026. They apply on 15 August.
Super Fund Lookup: up to 56 days from 15 August. 16 days to 31 August, 30 days to 30 September, then 10 more days: 16 + 30 + 10 = 56, so Registered by 10 October 2026 at the latest.
First annual return: as a new fund they pay a $518 levy, being 2 x $259, covering the current and next year.
Rule of thumb: nothing moves into the SMSF until the fund shows as Registered, the bank account and ESA are recorded with the ATO, and every trustee declaration is signed.
Common mistakes when setting up an SMSF
- Missing the 60-day window: a late application needs written reasons and can be refused.
- No director ID: a corporate trustee cannot pass registration review without one for every director.
- Shared bank accounts: the account must belong to the fund alone, and assets must be kept separate from personal assets.
- A template investment strategy: 0 to 100% ranges without reasoning do not meet the ATO standard.
- Forgetting the first annual return: a new fund’s return may be due 31 October, and the fund needs an approved auditor each year. See our SMSF compliance and audit guide and SMSF setup compliance notes.
FAQ about SMSF setup
How long does it take to set up an SMSF?
It depends on how quickly the deed, trustee company and paperwork come together. Once you apply, the ATO says it can take up to 56 days for the fund to show as Registered on Super Fund Lookup, and a notice of compliance follows within 7 days of that status. Plan for several weeks before any rollover can arrive.
How many members can an SMSF have?
An SMSF can have up to six members. Every member must be a trustee, or a director of the corporate trustee, and every trustee must be a member. A single-member fund with individual trustees needs a second trustee, while a corporate trustee lets a sole member run the fund as the only director.
Do I need a director ID for a corporate trustee?
Yes. Every director of the trustee company needs a director ID, and ASIC says you must apply before you are appointed. The ATO says funds with a corporate trustee whose directors lack a director ID cannot proceed through registration review. The maximum penalty for not having one is 60 penalty units.
What happens if I miss the 60-day registration window?
The ATO says you have 60 days after the fund is legally established to register it and elect to be regulated. If you apply later, you must give written reasons for the delay, and the application may be refused. Without the election, the fund does not get the concessional tax treatment of a regulated super fund.
Can I roll my super into the SMSF straight away?
No. Large funds and employers will not transfer money until the SMSF shows as Registered on Super Fund Lookup. You also need a dedicated bank account and an electronic service address recorded with the ATO, because rollovers and employer contributions travel through SuperStream. Once money arrives, allocate it to member accounts within 28 days of month end.
